Terms and Conditions: Overview
These Terms and Conditions (the "Terms") are presented by ZAHA Trading LLC (referred to as "ZAHA Trading", "the Provider", "we", "us", or "our"), a registered business entity. These Terms establish the legally binding rules and responsibilities between the Provider and you (referred to as the "Trader", "Customer", or "you") regarding your use of the evaluation challenges and professional services provided by Burmese Funded Trader (BFT) (collectively referred to as the "Services").
Our Services are primarily accessible through our official website and designated trading platforms. By visiting our website, purchasing an evaluation, or engaging with our Services, you validate that you have read, understood, and consented to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease use of the Website and Services.
1. Eligibility and Acceptance
The Services are strictly available to individuals who are at least 18 years of age and who reside in jurisdictions where such services are legally permitted. It is the Customer’s responsibility to ensure compliance with local laws. We reserve the right to update, change, or replace any part of these Terms at any time. Your continued use of the Website following any updates constitutes acceptance of those changes.
2. Professional Disclaimer (Not Investment Advice)
IN ACCORDANCE WITH APPLICABLE LAWS:
NONE OF THE SERVICES PROVIDED BY ZAHA TRADING LLC CONSTITUTE INVESTMENT SERVICES, FINANCIAL ADVICE, OR BROKERAGE SERVICES.
The Provider does not provide any guidance, instructions, or information regarding how the Customer should perform transactions.
No information provided on our Website or by our staff should be interpreted as investment advice.
ZAHA Trading LLC explicitly disclaims any responsibility for trades executed by the Customer; all trading is performed in a simulated environment for evaluation purposes.
3. Registration Fees and Refund Policy
The Customer must pay a one-time registration or onboarding fee to access the Services.
Finality of Payment: Once the Service has commenced (i.e., the Customer has placed their first trade) or if the Customer fails to complete the Evaluation, the Customer is not entitled to a refund.
Evaluation Purpose: All payments are made solely for the purpose of accessing the Evaluation environment and associated professional tools.
4. Third-Party Access
We may provide authorized third-party technical partners access to our infrastructure for maintenance, debugging, or database security. These accesses are strictly monitored and restricted to the scope of technical necessity.
Section 1 – Terms of Online Registration
By registering for a Burmese Funded Trader (BFT) Evaluation, the Customer officially confirms they are at least 18 years of age or the legal age of majority in their jurisdiction. As a condition of using our Services, the Customer agrees not to engage in any illegal, unauthorized, or manipulative activities. This includes, but is not limited to, the infringement of intellectual property or copyright laws. Any violation of these Terms will result in the immediate termination of the Customer’s access to the Services without a refund.
Section 2 – General Conditions
ZAHA Trading LLC reserves the right to refuse or terminate Service to any individual at any time, at our sole discretion. This includes cases of suspected fraud, platform abuse, breach of trading rules, or attempts to manipulate evaluations.
Data Security: The Customer acknowledges that their content (excluding sensitive payment information) may be transferred unencrypted over various networks to conform to technical requirements. All credit card and payment information is always encrypted during transfer.
Proprietary Rights: The Customer agrees not to reproduce, duplicate, copy, sell, or exploit any portion of the Service, its technology, or website content without express written consent from the Provider.
Headings: The headings used in this Agreement are for convenience only and do not limit or affect these Terms.
Section 3 – Information Accuracy, Completeness, and Timeliness
The Customer acknowledges that all Services and content are provided "as is" and used solely at the Customer's own risk. While ZAHA Trading LLC endeavors to maintain accurate and up-to-date information, we recognize that technology and market data may have inherent limitations.
Disclaimer: To the maximum extent permitted by law, the Provider disclaims all warranties—whether express or implied—including merchantability or fitness for a particular purpose, except as explicitly stated in our official FAQs or policies.
Section 4 – Changes to the Service and Prices
All product and evaluation prices are subject to change without prior notice. ZAHA Trading LLC reserves the right to modify, suspend, or discontinue any part of the Service (including specific account types, leverage, or rules) at any time. We shall not be liable to the Customer or any third party for any modification, price adjustment, or discontinuance of the Service.
Section 5 – Scope of Products and Services
We reserve the right, but are not obligated, to limit the sale of our Services to any person, geographic region, or jurisdiction on a case-by-case basis.
Modifications: All descriptions of products or pricing are subject to change at our sole discretion. Any offer made on this Website is void where prohibited by local law.
Service Expectations: The Provider does not warrant that the quality of any information or materials obtained by the Customer will meet specific personal expectations, although we strive for the highest industry standards. Errors in the Service will be corrected as they are identified at the Provider’s discretion.
Section 6 – Account Information and Billing Accuracy
ZAHA Trading LLC reserves the right to refuse or cancel any order at our sole discretion.
Order Limitations: We may limit or cancel quantities purchased per person, per household, or per order. These restrictions may apply to orders placed under the same Customer account, the same credit card, or utilizing the same billing address. If an order is modified or cancelled, we will attempt to notify the Customer via the email or billing contact information provided.
Prohibited Users: We reserve the right to prohibit orders that, in our judgment, appear to be placed by unauthorized resellers, dealers, or distributors.
Customer Responsibility: The Customer agrees to provide current, complete, and accurate purchase and account information. You must promptly update your email, payment details, and expiration dates to ensure successful transactions and communication.
Withdrawal Processing Fees: To cover the transaction costs incurred by our payment processors, a processing fee of up to 3.5% may apply to all withdrawal requests.
These fees are determined by the payment providers and market conditions.
ZAHA Trading LLC does not add any additional markups or hidden charges to these fees. By submitting a payout request, the Customer acknowledges and consents to these standard processing deductions.
Section 7 – Third-Party Resources and Optional Tools
The Provider may offer access to third-party tools (such as economic calendars, analytical software, or trading calculators) over which we have no direct control or input.
"As-Is" Access: The Customer acknowledges that access to such tools is provided "as is" and "as available" without any warranties, endorsements, or conditions of any kind. ZAHA Trading LLC shall have no liability arising from or related to the Customer's use of these optional third-party tools.
User Risk: Use of these tools is entirely at the Customer's own risk and discretion. Customers should ensure they are familiar with and approve of the terms provided by the respective third-party vendors.
Future Services: Any new features, tools, or resources added to the Website in the future shall also be subject to these Terms.
Section 8 – External Links and Third-Party Materials
Certain content, products, and Services available via BFT may contain materials from third parties.
Non-Affiliation: Links on our Website may direct you to third-party websites that are not affiliated with ZAHA Trading LLC. We are not responsible for examining or evaluating the content or accuracy of these external sites.
Liability: The Provider shall not have any liability or responsibility for third-party materials, websites, products, or services. We are not liable for any harm or damages related to the purchase or use of goods, resources, or transactions made in connection with any third-party websites.
Trader Responsibility: It is the Customer's responsibility to review the third party's policies and practices carefully before engaging in any transaction.
Section 9 – User Comments, Feedback, and Submissions
The Customer agrees that ZAHA Trading LLC may, at any time and without restriction, edit, copy, publish, and distribute any comments or feedback sent to the Provider (excluding personal or private trading-account data).
Obligations: The Provider is under no obligation to (1) maintain comments in confidence; (2) pay compensation for feedback; or (3) respond to every comment.
Content Standards: We reserve the right to monitor, edit, or remove content that we deem unlawful, offensive, threatening, or otherwise objectionable.
Prohibited Conduct: The Customer warrants that their comments will not violate any third-party rights, contain malware, or use a false identity. The Customer is solely responsible for the accuracy of their comments.
Mutual Respect: Both the Customer and the Provider shall conduct all interactions with the highest degree of fairness and respect. Any action detrimental to the reputation of either party—during or after the trading relationship—is strictly prohibited and may result in immediate legal action or account termination.
Section 10 – Personal Information
The submission of personal data through the Website and trading platforms is strictly governed by the ZAHA Trading LLC Privacy Policy.
Section 11 – Errors, Inaccuracies, and Omissions
Information on the Website or within the Service may occasionally contain typographical errors or inaccuracies related to product descriptions, pricing, or promotions.
Corrections: ZAHA Trading LLC reserves the right to correct any errors and to change, update, or cancel orders at any time without prior notice (including after an order has been submitted).
Reporting Discrepancies: In the event of any anomalies in account details or transactions, the Customer must promptly report the issue to BFT Support via live chat or by emailing support@burmesefundedtrader.com.
Reporting Timelines: To ensure a fair and timely resolution of technical concerns, the Customer is expected to raise any issues regarding CFD Services within three (3) weeks and any Futures Services within seven (7) calendar days of the occurrence. Failure to report within these windows may limit the Provider's ability to take corrective action.
Section 12 – Restricted Uses
The Customer is strictly prohibited from using the Website, trading platforms, or content:
(a) For any illegal purpose or to solicit others to perform unlawful acts.
(b) To violate international, federal, or local regulations and ordinances.
(c) To infringe upon the intellectual property rights of ZAHA Trading LLC or any third party.
(d) To engage in harassment, abuse, defamation, or discrimination based on gender, religion, ethnicity, race, age, or disability.
(e) To submit false, misleading, or fraudulent information during registration or KYC.
(f) To upload malicious code, viruses, or scripts intended to disrupt the Service or the Internet.
(g) To use unauthorized automated systems, bots, or scripts to exploit the dashboard or Services. Only approved Expert Advisors (EAs) used for risk or trade management within permitted platforms are allowed.
Export & Jurisdictional Restrictions:
ZAHA Trading LLC complies with international standards, including OFAC and FATF. While we strive to support the global trading community, we do not offer Services to residents of countries currently under comprehensive international sanctions (e.g., North Korea, Iran, Syria, etc.).
Note on Myanmar: We provide specialized local payment gateways for users in Myanmar. However, users must ensure their participation complies with all local and international financial regulations.
Account Termination: We reserve the right to immediately terminate a Customer's access to the Service for any breach of these restricted uses.
Section 13 – Limitation of Liability; Disclaimer of Warranties
ZAHA Trading LLC does not represent or warrant that your use of the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the simulation platform will be accurate or reliable for live market performance.
Service Availability: The Customer acknowledges that we may suspend or cancel the Service for indefinite periods at any time, with or without notice.
"As-Is" Provision: The Service and all products delivered to the Customer are provided 'as is' and 'as available' for the Customer's use, without any warranties of merchantability, fitness for a particular purpose, or non-infringement.
Not a Financial Institution: ZAHA Trading LLC is not a broker, fiduciary, or financial advisor. We owe no duty of care beyond providing access to the simulated trading platform.
Liability Cap: In no event shall ZAHA Trading LLC, its directors, officers, or employees be liable for any injury, loss, claim, or any direct/indirect damages—including lost profits, lost revenue, or loss of data—arising from your use of the Service. This includes errors in content or damages resulting from the use of the platform, except in cases of gross negligence or willful misconduct. In jurisdictions where the exclusion of liability for consequential damages is not allowed, our liability shall be limited to the maximum extent permitted by law.
Section 14 – Indemnification
The Customer agrees to indemnify, defend, and hold harmless ZAHA Trading LLC, including its parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, and employees, from any claims or demands (including reasonable attorneys' fees) made by any third party. This applies to claims arising from the Customer's breach of these Terms, the documents incorporated by reference, or the Customer's violation of any law or the rights of a third party.
Section 15 – Severability
In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the maximum extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms; such determination shall not affect the validity and enforceability of any other remaining provisions.
Section 16 – Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
By the Customer: You may terminate these Terms at any time by notifying BFT Support that you no longer wish to use our Services or by ceasing all use of the Website.
By the Provider: ZAHA Trading LLC may terminate this agreement immediately and without notice if, in our sole judgment, you fail to comply with any term or provision. Upon termination, you remain liable for all amounts due up to the date of termination, and access to the Services will be denied.
Section 17 – Entire Agreement
The failure of ZAHA Trading LLC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right.
Exclusivity: These Terms, along with any operating rules or policies posted by us, constitute the entire agreement and understanding between the Customer and the Provider. This agreement governs your use of the Service and supersedes any prior agreements, communications, or proposals (oral or written).
Interpretation: Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
Section 18 – Governing Law
These Terms, and any separate agreements whereby we provide you Services, shall be governed by and construed in accordance with the laws of the jurisdiction in which ZAHA Trading LLC is registered. All disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in that region.
Section 19 – Local Law Compliance
The Customer is advised to be fully aware of and comply with all local laws and regulations pertaining to their participation in our Services.
User Risk: The Customer acknowledges they are engaging in the Service at their own risk. By using the Services, the Customer affirms they are over 18 years of age and understands that ZAHA Trading LLC is not responsible for any actions taken by the Customer that may violate local laws.
Section 20 – Changes to Terms of Service
ZAHA Trading LLC reserves the right to modify, update, or revise these Terms at any time at our sole discretion.
Notification: Significant changes will be communicated via the Website dashboard or via the email address provided during registration.
Responsibility: It is the Customer’s responsibility to review these Terms periodically. Continued use of the Services following the posting of changes constitutes acceptance of the revised Terms.
